Please read these Terms of Service carefully before using the Solys AI platform. By accessing or using our Services, you agree to be bound by these terms. If you do not agree, do not use the Services.
Solys AI provides a done-for-you AI receptionist platform for Caribbean service businesses. The Services include:
The specific features available depend on your subscription tier (Core, Pro, Scale, or Custom). We reserve the right to modify, update, or discontinue features with reasonable notice.
To use the Services, you must create an account with accurate and complete information. You are responsible for:
Multi-factor authentication (MFA) is required for all accounts and cannot be disabled. Concurrent session limits apply based on your subscription plan.
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of your business.
The Services are provided on a monthly subscription basis. Pricing is as follows:
Subscriptions are billed monthly in advance. Payments are non-refundable except as required by applicable law. We reserve the right to adjust pricing with 30 days' written notice. Founding cohort rates are locked and will not be increased for the duration of your continuous subscription.
If payment fails, we will notify you and may suspend access to the Services until payment is received. Accounts with overdue payments for more than 14 days may be terminated.
You agree not to use the Services to:
You are responsible for ensuring your end-users have provided appropriate consent to be contacted by your AI receptionist. We are not liable for violations of messaging consent laws caused by your deployment of the Services.
You retain ownership of all content and data you submit to the Services, including your business information, knowledge base, and your end-users' data. By using the Services, you grant Solys AI a limited, non-exclusive licence to process your content solely as necessary to provide the Services.
You represent and warrant that:
You are the data controller for your end-users' personal information. Solys AI acts as your data processor. Our processing of end-user data is governed by our Privacy Policy and any applicable data processing agreements.
The Solys AI platform uses large language models (currently Anthropic Claude) to generate responses on behalf of your business. You acknowledge that:
You should not rely on the AI receptionist for advice that requires professional qualifications — medical diagnosis, legal advice, financial recommendations, or similar regulated activities. The platform is designed for appointment booking, enquiry handling, and lead management.
The Services integrate with third-party platforms including Google Calendar, WhatsApp (Meta Cloud API), Twilio, and others. Your use of these integrations is subject to the respective third parties' terms of service and privacy policies.
Solys AI is not responsible for the availability, accuracy, or conduct of third-party services. If a third-party integration becomes unavailable, we will endeavour to provide an alternative or workaround where possible.
By connecting a third-party service through the platform, you authorise Solys AI to access and use that service on your behalf as necessary to provide the Services you have subscribed to.
The Solys AI platform, including its software, design, branding, and documentation, is the exclusive intellectual property of Solys AI. Nothing in these Terms grants you any ownership rights in the platform.
You retain all intellectual property rights in your own content and business data. The AI receptionist configurations we create for you during onboarding are yours to use for as long as your subscription is active.
You may not use the Solys AI name, logo, or branding without our prior written consent, except to identify that your business uses the Solys AI platform.
Each party agrees to keep confidential any non-public information disclosed by the other party in connection with the Services that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information.
Solys AI will not disclose your business configuration, customer data, or proprietary information to any third party except as required to provide the Services or as required by law.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOLYS AI DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOLYS AI'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO SOLYS AI IN THE THREE MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL SOLYS AI BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, the above limitations apply to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless Solys AI and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
These Terms commence when you first access the Services and continue until your subscription is terminated.
Termination by you: You may cancel your subscription at any time by contacting support@solysai.com. Cancellation takes effect at the end of your current billing period. No refunds are provided for unused portions of a billing period.
Termination by us: We may suspend or terminate your account immediately if you violate these Terms, fail to pay amounts due, or engage in conduct that we reasonably believe may harm Solys AI, other users, or third parties. We will provide notice where practicable.
Effect of termination: Upon termination, your access to the Services will cease. We will retain your data for 90 days after termination, during which you may request an export. After 90 days, your data will be permanently deleted unless retention is required by law.
These Terms are governed by the laws of Jamaica. Any disputes arising from or related to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Jamaica.
Before initiating any formal dispute process, you agree to contact us at support@solysai.com and give us 30 days to attempt to resolve the issue informally.
We may update these Terms from time to time. When we make material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
If you do not agree to the updated Terms, you may terminate your subscription before the effective date of the changes.
