These guidelines explain how law enforcement agencies and government bodies may request information from Solys AI, and how we respond. They exist to protect our clients and their customers while meeting our legal obligations. Nothing here waives any objection or legal right available to Solys AI or the affected parties.
Solys AI provides an AI receptionist and CRM platform to businesses. In most cases we act as a data processor on behalf of the business (the data controller). Depending on the account, we may hold: business account details, conversation transcripts across web chat, WhatsApp, email and voice, contact details of the business's customers, appointment records, and consent records. We do not hold payment card numbers (processed by our payment provider) and we do not record voice calls beyond transcripts unless a client has enabled it.
We disclose user or customer data to law enforcement only where legally compelled. Requests must:
Requests from outside Jamaica should be made through mutual legal assistance treaties (MLAT) or letters rogatory addressed to the competent Jamaican authorities, unless another lawful basis for direct disclosure applies. Jamaica's Data Protection Act restricts transfers of personal data outside Jamaica except under specified conditions.
Where we believe in good faith that disclosure is necessary to prevent imminent death or serious physical harm to a person, we may disclose limited information to law enforcement without legal process. Emergency requests must state the nature of the emergency and why disclosure without process is necessary, and are reviewed by a human before any disclosure.
Our policy is to notify the affected business client before disclosing their data, unless we are legally prohibited from doing so or notification would create risk of harm. Where a legal prohibition is time-limited, we notify once it lapses.
We will preserve existing records for up to 90 days upon receipt of a valid written preservation request while legal process is obtained. Preservation is not disclosure.
